Greenwire: SCOTUS asked to sort out WOTUS jurisdiction
Critics of the Obama administration’s Clean Water Rule. also known as the Waters of the United States rule, have asked the Supreme Court to decide where legal challenges over the rule will play out, Greenwire reported Tuesday.
On Friday, the National Association of Manufacturers filed a petition for the high court to take up the question. The Supreme Court petition challenges a decision by a three-judge panel of the 6th U.S. Circuit Court of Appeals that federal appellate courts — not local district courts — have jurisdiction to hear challenges to the rule under the Clean Water Act.
The Cincinnati-based court also put the rule on hold nationwide while litigation plays out.
